End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and Intrepid Reality, LLC (“Company,” “we,” “us,” or “our”) regarding your use of the Intrepid Reframe application (“App”) and any related services, content, or documentation (collectively, the “Services”).

By downloading, installing, or using Intrepid Reframe, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

License Grant

Subject to your compliance with this Agreement, Intrepid Reality, LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use one copy of the App on each Apple-branded device you own or control, as permitted by the App Store Terms of Service; and
  • Use the App solely for personal or internal business purposes in accordance with this Agreement and Apple’s Usage Rules.

Restrictions

You may not:

  1. Copy, modify, or create derivative works based on the App or any part thereof.
  2. Distribute, sublicense, lease, sell, or transfer the App to any third party.
  3. Reverse engineer, decompile, disassemble, or attempt to derive the App’s source code, except where permitted by law.
  4. Circumvent or disable security features or digital rights management.
  5. Use the App in any unlawful, fraudulent, or harmful manner; or
  6. Use the App to collect or store personal data of others without consent.

Intellectual Property

All rights, title, and interest in and to the App, including all content, code, images, graphics, text, and trademarks, are owned by Intrepid Reality, LLC or its licensors and are protected by applicable intellectual property laws. This Agreement does not transfer any ownership rights to you.

User Content

You may capture, annotate, and store video frames and related data (“User Content”) through the App. You retain all ownership rights to your User Content.

By using the App, you grant us a limited, non-exclusive, worldwide license to store, transmit, and process your User Content solely as necessary to provide and improve the App’s functionality (including synchronization via iCloud / CloudKit).

You are solely responsible for the content you create and must ensure you have all rights and permissions necessary to use, share, or distribute that content.

Privacy

Your use of the App is subject to the Intrepid Reframe Privacy Policy, available at: https://intrepidreality.com/privacy

The App may use iCloud, CloudKit, or similar Apple frameworks for data synchronization across devices. Information processed in this way remains subject to the Apple privacy policy and our respective privacy policies.

Subscriptions and In-App Purchases

Certain features of the App require a paid subscription. Subscription terms, renewal periods, and pricing are disclosed in the App Store.
Payments and cancellations are managed through your Apple ID account in accordance with the App Store Terms of Service.
Refunds are handled exclusively by Apple.

Termination

This Agreement is effective until terminated by you or by Intrepid Reality, LLC.
You may terminate it at any time by deleting the App from your device.
We may terminate this Agreement if you fail to comply with its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied.
We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components.

Limitation of Liability

To the maximum extent permitted by law, Intrepid Reality, LLC and its affiliates, officers, employees, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages; or
  • Any loss of data, profits, or business opportunities, arising out of your use or inability to use the App, even if advised of the possibility of such damages.

Our total liability to you for all claims shall not exceed the amount you paid (if any) for using the App during the 12-month period preceding the event giving rise to the claim.

Third-Party Services

The App may integrate with third-party services such as Apple frameworks. Intrepid Reality, LLC is not responsible for any acts or omissions of those third parties.

Indemnification

You agree to defend, indemnify, and hold harmless Intrepid Reality, LLC, its affiliates, officers, employees, and contractors from and against all claims, damages, liabilities, losses, and expenses arising from your use of the App, violation of this Agreement, or infringement of any third-party rights.

Export Compliance

You must comply with all applicable export control and sanctions laws when using the App. You may not use or export the App in violation of U.S. or international regulations.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Laramie County, Wyoming, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

This Agreement, together with the Privacy Policy and App Store Terms of Service, constitutes the entire agreement between you and Intrepid Reality, LLC regarding the App and supersedes all prior agreements or understandings.
